PILOTLOGBOOK Product License Agreement

This License Agreement ("Agreement") is a legal contract between you ("Licensee" or "you") and PILOTLOGBOOK© ("Licensor," "we," "us," or "our") for the use of PILOTLOGBOOK products ("Products"), including but not limited to Excel spreadsheets, digital tools, and any other offerings provided by PILOTLOGBOOK©. By purchasing, downloading, or using any of our Products, you agree to be bound by the terms of this Agreement.

1. License Grant

Subject to the terms and conditions of this Agreement, Licensor hereby grants you a limited, non-exclusive, non-transferable, non-sublicensable license to use the Products for your personal or professional use.

2. Restrictions

You shall not:

a) Modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the Products;

b) Distribute, sublicense, rent, lease, loan, or otherwise transfer the Products to any third party;

c) Remove, alter, or obscure any proprietary notices on the Products;

d) Use the Products in any manner that violates applicable laws or regulations.

3. Ownership

Licensor retains all right, title, and interest in and to the Products, including all intellectual property rights. This Agreement does not grant you any rights to patents, copyrights, trade secrets, trademarks, or any other rights in respect to the Products.

4. User Responsibilities

You agree to:

a) Provide accurate, current, and complete information during the purchase process and update such information as necessary;

b) Use the Products in compliance with all applicable laws and regulations;

c) Be solely responsible for any data input into the Products.

5. Privacy and Data Protection

Your use of the Products is subject to our Privacy Policy, which outlines how we collect, use, and protect your personal information. By using the Products, you consent to such data practices.

6. Refund Policy

We offer a refund if you are not satisfied with the purchase within 3 days of the order date, subject to the terms of our Refund Policy.

7. Disclaimer of Warranties

THE PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. LICENSOR SPECIFICALLY DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LICENSOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

a) YOUR USE OR INABILITY TO USE THE PRODUCTS;

b) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN.

9. Termination

This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically without notice if you fail to comply with any of its terms. Upon termination, you shall cease all use of the Products and destroy all copies.

10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law principles.

11. Modifications to the Agreement

Licensor reserves the right to modify this Agreement at any time. Any changes will be posted on our website, and the effective date will be updated accordingly. Your continued use of the Products after any changes signifies your acceptance of the updated Agreement.
